The Assistant County Attorney position is located in Ossipee, New Hampshire, the county seat of Carroll County.

Under the direct supervision of the Carroll County Attorney the Assistant County Attorney seeks justice with professionalism, excellence, and pride, consistent with the New Hampshire Rules of Professional Conduct, American Bar Association, and National District Attorney’s Association guidelines, as a criminal prosecutor with a concentration in Superior Court.

The individual in this position researches pertinent case law, drafts indictments, complaints & pleadings and further presents investigations and cases to the Grand Jury, conducts Bench trials, Jury trials, and all required hearings related to their assigned caseload. They maintain a collaborative working relationship with victim/witness coordinators to ensure that all victims and witnesses are properly informed, prepared, and supported through the prosecution process. Further, they collaborate with police, members of the public, and court staff.

PRIMARY RESPONSIBILITIES:

  • Acts as trial counsel in actions brought for, or against the County, and handles all aspects of the investigation, preparation and prosecution of matters within the statutory and common law jurisdiction of the County Attorney; this includes but is not limited to the following:
  • Effectively prepares and prosecutes all levels of felony, misdemeanor and violation charges in an assigned caseload, as well as juvenile cases as assigned, and some statutory committal matters in the District, Superior and Probate Courts.
    1. Drafts indictments, complaints and petitions.
    2. Prepares all forms and pleadings necessary to bring to completion any matter in the statutory jurisdiction of the office.
    3. Researches pertinent case law, decisions and legislation.
    4. Presents investigations and cases to the Grand Jury; Conducts Bench trials, Jury trials and all required hearings related to the assigned caseload.
  • Interacts with the Victim/Witness Coordinators to ensure that all witnesses/victims are properly informed, prepared and supported throughout the prosecution process.
  • investigates and responds to complaints from within and without and conducts internal investigations.
  • Assists local law enforcement agencies in charging and other legal decisions at the felony/misdemeanor/violation level.
  • Rotating responsibility as on-call duty attorney, the individual provides counsel and supervises law enforcement agencies during nighttime and weekends; responds to major motor vehicle collisions where charges might result, and to all major crime scenes where County Attorney presence is warranted.
  • Adheres to and upholds the New Hampshire Rules of Professional Conduct and the ABA and NDAA prosecutorial guidelines, and all policies as delineated in the Carroll County Attorney’s Office Manual.
  • Performs all other duties where needed and as assigned in all things incidental to the prosecution efforts of the office.
  • Work hours in general, are 8:30 a.m. to 4:30 p.m. Monday through Friday; however, this salaried position requires great flexibility to accommodate evening and weekend hours as the need demands. Frequent off hour telephone consults may be necessary.

EDUCATION, LICENSES, EXPERIENCE, AND ABILITIES:

  • Juris Doctor from accredited law school.
  • Must be a member in good standing of the New Hampshire Bar Association.
  • Three to five years’ experience as a criminal trial attorney with, and [preferably] at least one year of other legal experience.
  • In-depth knowledge of principles and rules of law, rules of evidence and the New Hampshire criminal justice system.
  • Ability to effectively analyze information in a short period of time.
  • Ability to effectively interact with individuals at all levels.
  • Strong written and oral advocacy skills are required.
  • Excellent judgment, tact, courtesy, maturity, and communication (written and oral) skills are essential.
  • Must have reliable transportation as travel is required.
